Individual applications to the Constitutional Court form the foundation of applications to the ECtHR. In almost all legal proceedings, an application cannot be made to the ECtHR without first applying to the Constitutional Court. Even if an application is submitted directly to the ECtHR, it is likely to be rejected for failure to exhaust domestic remedies. Therefore, it is crucial that individual applications to the Constitutional Court are prepared as if they were being submitted to the ECtHR.

Given the short time limit for filing an individual application after the final decision, the importance of properly preparing the application becomes even more significant.
